Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of One Click Artist ("One Click Artist," "we," "us," or "our"), including our website at oneclickartist.net and related services (collectively, the "Service"). By creating an account, connecting a store, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Description of the Service

One Click Artist is a business tool for artists, galleries, and merchants. The Service helps you manage artwork catalogs, generate price cards and certificates of authenticity, create room mockups, and synchronize product information with connected e-commerce platforms such as Shopify and WooCommerce.

Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate account information and notify us promptly if you suspect unauthorized access.

Authentication may be provided through third-party identity providers (such as Google sign-in). Your use of those providers is subject to their respective terms and policies in addition to these Terms.

Your Content

You retain ownership of the artwork images, product data, artist information, and other content you upload or submit through the Service ("Your Content"). You grant us a limited, non-exclusive license to host, process, display, and transmit Your Content solely as necessary to operate and improve the Service, including generating documents, mockups, and store listings you request.

You represent that you have the rights needed to upload and use Your Content through the Service, and that Your Content does not infringe the intellectual property, privacy, or other rights of any third party.

E-Commerce Integrations

When you connect a Shopify, WooCommerce, or other supported store, you authorize One Click Artist to access and modify product data in that store as needed to provide synchronization features you enable. You remain responsible for your store, its listings, pricing, inventory, compliance with marketplace rules, and all sales to your customers.

We are not a party to transactions between you and your end-customers. Disconnecting a store or uninstalling our Shopify app stops future synchronization but may not remove products already published to your store.

Acceptable Use

You agree not to misuse the Service. Without limiting other restrictions, you may not:

• Use the Service for unlawful, fraudulent, or misleading purposes.
• Upload content you do not have the right to use, or content that is defamatory, obscene, or otherwise objectionable.
• Attempt to gain unauthorized access to the Service, other accounts, or connected systems.
• Reverse engineer, scrape, or interfere with the normal operation of the Service.
• Resell or sublicense the Service except as expressly permitted by us in writing.

AI-Assisted Features

Some features may use automated or AI-assisted processing to help extract or organize information from images or documents you provide. Outputs are provided for convenience and may contain errors. You are responsible for reviewing and verifying any AI-generated or automated results before relying on them for pricing, catalog records, certificates, or store listings.

Fees and Payment

Certain features of the Service may be offered free of charge while others may require payment in the future. If paid plans are introduced, we will describe applicable fees before you are charged. Unless otherwise stated, fees are non-refundable except where required by law.

Third-Party Services

The Service integrates with third-party platforms and providers, including authentication, hosting, e-commerce, and AI services. Those services are governed by their own terms and privacy policies. We are not responsible for third-party services and do not guarantee their availability or performance.

Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SYNCHRONIZED STORE DATA WILL ALWAYS BE ACCURATE OR COMPLETE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONE CLICK ARTIST AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Indemnification

You agree to defend, indemnify, and hold harmless One Click Artist and its operators from claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your connected stores, or your violation of these Terms or applicable law.

Suspension and Termination

You may stop using the Service at any time and may delete your account through your account settings or by contacting us. We may suspend or terminate access to the Service if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, provisions that by their nature should survive will remain in effect, including ownership, disclaimers, limitation of liability, and indemnification.

Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date above. Material changes may also be communicated through the Service or by email. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by applicable law, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the courts of competent jurisdiction, except where prohibited by mandatory consumer protection laws in your country of residence.
